Returns and Refunds
Art. 23. Right of withdrawal

1. The Consumer Customer has the right to withdraw from the contract, without indicating the reasons, within 14 (fourteen) days. The withdrawal period expires after 14 (fourteen) days from the day on which the Consumer Customer or a third party other than the carrier and designated by him acquires physical possession of the products.

2. In the case of a contract relating to multiple products ordered by the Consumer Customer, in a single order and delivered separately, the withdrawal period expires after 14 (fourteen) days from the day on which the Customer Consumer or a third party other than the carrier and designated by him, acquires physical possession of the last product.

3. To exercise the right of withdrawal, the Consumer Customer is required to inform Viauguri of one of the addresses listed below: e-mail viauguri@gmail.com.

4. The Consumer Customer must communicate his decision to withdraw from the contract stipulated with Viauguri by means of an explicit declaration, sending a letter by post, or e-mail to the addresses indicated in the previous paragraph. To this end, the Consumer Customer can freely choose to use the standard withdrawal form attached to the Instructions on the right of withdrawal, but it is not mandatory.

5. To comply with the withdrawal deadline, it is sufficient for the Consumer Customer to send the communication concerning the exercise of the right of withdrawal before the expiry of the withdrawal period.

6. According to the art. 54, paragraph 4, of the Consumer Code, the burden of proof relating to the exercise of the right of withdrawal lies with the Consumer Customer, therefore it is advisable that this communication be sent to Viauguri by registered letter with acknowledgment of receipt to the following address: Via Delle Fornaci 215 00165 Rome; or by email to viauguri@gmail.com; or by any other means suitable to demonstrate with certainty the sending and receiving of the communication by Viauguri.

 

Art. 24. Effects of withdrawal

1. If the Consumer Customer withdraws from the contract stipulated with Viauguri, he will be reimbursed for all the payments he has made, including delivery costs (except for the additional costs deriving from his choice of a type of delivery other than the less expensive type of standard delivery offered by Viauguri), without undue delay and in any case not later than 14 (fourteen) days from the day on which Viauguri was informed of the decision of the Consumer Customer to withdraw from the contract.

2. These refunds will be made using the same payment method used by the Consumer Customer for the initial transaction, unless he has expressly agreed otherwise; in any case, the Consumer Customer will not incur any fees as a result of such reimbursement. The reimbursement may be suspended until receipt of the goods, or until the demonstration by the Consumer Customer of having sent back the goods, if earlier.

3. The Consumer Customer must return the goods or deliver them to Viauguri at the following address: Via Delle Fornaci 215 00165 Rome, without undue delay and in any case within 14 (fourteen) days from the day on which he communicated his withdrawal from the contract to Viauguri . The deadline is met if the Consumer Customer sends back the goods before the expiration of the period of 14 (fourteen) days.

4. The direct costs of returning the goods will be charged to the Consumer Customer.

5. The Consumer Customer is only responsible for the decrease in the value of the goods resulting from the handling of the goods other than that necessary to establish the nature, characteristics and functioning of the goods.

 

Art. 25. Cases of exclusion of the right of withdrawal

1. The Consumer Customer cannot exercise the right of withdrawal provided by the art. 24 ("Right of withdrawal") in the following cases: (a) if the goods are made to measure and / or clearly personalized; (b) if the goods are liable to deteriorate or expire rapidly; (c) if the sealed goods, opened after delivery, do not lend themselves to being returned for hygienic reasons or related to health protection; (d) sealed food products once opened; (e) if the goods, due to their delivery, are inseparably mixed with other goods after delivery; (f) audiovisual products or computer software sealed, opened by the consumer; (g) newspapers, periodicals and magazines.

2. The Professional Customer cannot, under any circumstances, have any right of withdrawal.
